When a person (hereinafter referred to as ‘Client’) that is registered with Yacht Week East Africa (hereinafter referred to as ‘YachtWeekEA’) pays YachtWeekEA a deposit or full- or part-payment to attend a Yacht Week East Africa event, the Client enters into an agreement with YachtWeekEA for all matters relating to the event connected to the booking, and full acceptance of these Terms and Conditions, by the Client is assumed.
CANCELLATION POLICY: You have 24 hours from the time of booking to cancel a trip for a full refund of the deposit. After 24 hours, the deposit - and all future payments - are non-refundable. We highly recommend you purchase a comprehensive travel insurance policy that includes trip cancellation coverage that includes a "Cancel for Any Reason" option to cover your non-refundable trip. Trip cancellation insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your trip for any reason, whether voluntary or as a result of YachtWeekEA's actions.
TRANSFER POLICY: You can transfer your trip for no charge to another person by notifying us via email.
TRAVEL/MEDICAL INSURANCE: It is a strongly recommended that everyone participating in the trip have a personal medical and travel insurance policies. It is the Client’s responsibility to buy/have these insurance policies. YachtWeekEA does not sell or organize travel/medical insurance.
RESPONSIBILITY: YachtWeekEA will use all due care for the provision of its services and activities provided to guests. Guests participate in YachtWeekEA activities at their own risk. No liability or responsibility is accepted by YachtWeekEA for any injury, illness, damage, loss, accident, death, expense, or any other claim related to YachtWeekEA activities, conduct, supervision, or the provision of its services. YachtWeekEA will not be liable for direct or indirect losses arising from any such injury, illness, damage, loss, accident, death, or expense including consequential loss or economic loss however caused. I agree to indemnify YachtWeekEA against any and all claims, actions, lawsuits, damages, and judgements, including attorney's fees arising out of or relating to my participation in the Yacht Week East Africa event.
YACHT SECURITY DEPOSIT (DOES NOT APPLY to LAND-BASED TRIPS): A Security Deposit is required for each yacht to cover the risk of damage to the yacht or loss of equipment. YachtWeekEA will pay the security deposit for the yacht(s). In the case of damage of a yacht, and/or loss of yacht equipment, the Client(s) on that particular yacht will bear all costs to be split evenly amongst them UNLESS one person acknowledges full responsibility. These additional fees, when charged by the Yacht Charter or Owner must be paid by the end of the event.
YACHT SPECIFICATIONS AND PICTURES: Yacht specifications and pictures provided at www.yachtweekea.com are intended to give Clients a general idea of the type of yacht they will be chartering. While we expect any differences to be immaterial, YachtWeekEA cannot guarantee that the yacht will be exactly the same as what is listed and shown on our website.
YACHTWEEKEA ITINERARY: While we expect to maintain our established itinerary, YachtWeekEA reserves the right to change the routing and/or the order of events due to unforeseen circumstances such as weather conditions. Any changes will be communicated to guests as early as possible.
PHOTO/VIDEO RELEASE: The client grants YachtWeekEA and its representatives and employees the right to use photographs and video testimony given by the Client during the YachtWeekEA event. I understand that at anytime during the trip I can decline to have my picture taken.
The Client authorizes YachtWeekEA and its transferees to copyright, use and publish the same in print and/or electronically. The Client understands that the video and photography taken during the trip will be made available online as well as print where available for such purposes as publicity, illustration, advertising, and web content.
The Client understands that YachtWeekEA will not disclose my name online or in printed media without additional expressed written consent from myself.
DAMAGES: We accept no responsibility for accidents, damage, baggage losses, delays and/or accidental expenses due to weather, strikes, acts of God, acts of governments or authorities, wars, terrorism, criminal acts committed by third parties, hostilities, civil disturbances, riots, strikes, sickness, quarantine, defects of vehicles or breakdowns in equipment, or to the fault or default of any used for YachtWeekEA events. Regarding any and all services and accommodations furnished, we expressly disclaim all responsibility or liability over any matter whatsoever for loss, damage, injury or expense to property or person due to any cause whatsoever occurring during the duration of the trip or otherwise. All such losses or expenses will be borne by the Client.
TRIP CANCELLATION FOR REASONS BEYOND OUR CONTROL: In the rare event that it becomes necessary to cancel a trip for reasons beyond our control, such as weather, strikes, acts of God, acts of governments or authorities, wars, terrorism, criminal acts committed by third parties, hostilities, civil disturbances, riots, strikes, sickness, quarantine, etc., we will reschedule the trip and/or issue a credit to be used for a YachtWeekEA trip within the same year, (if slots are available). There will also be the option to transfer the credit to another person. Your travel insurance should also cover these circumstances should they occur. Unfortunately, a refund would not be available.
The Client affirms that s/he has read the terms and conditions in their entirety, fully understands them, and voluntarily accepts them on free will and accord, free of any and all duress, coercion, and/or undue influence of any kind. These terms and conditions shall be construed in accordance with, and governed by, the laws of the country in which the event is held, and will not be construed in favor of or against either party, but in a manner that is fair to both parties. Any dispute between the parties shall be resolved by binding arbitration, which shall be conducted in the country in which the event is held.. No other agreement, statement, or promise made by the parties shall be binding on the parties. If any provision of these terms and conditions are held in whole or in part to be unenforceable for any reason, the remainder of that provision as well as the remaining terms and conditions will be severable and will remain in effect.
